Terms of Use

These Terms of Use govern your access to this website and your use of the applications published by Billes App Co Inc. (“Billes App Co”, “we”, “us”) (together, the “Services”). By using the Services you agree to these terms. If you do not agree, do not use the Services.

Legal entity

The legal entity behind these Terms of Use is Billes App Co Inc. This is the same legal name used for our Apple Developer account registration and associated business records.

Acceptance of these terms

Licence

Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use our applications on devices you own or control, for your own personal or internal business purposes. All rights not expressly granted are reserved.

Acceptable use

You agree not to:

copy, modify, translate, reverse engineer, decompile, or attempt to derive the source code of any application, except where such restriction is prohibited by law;
rent, lease, lend, sell, sublicense, or otherwise distribute the Services;
use the Services for any unlawful purpose or in violation of any applicable law;
interfere with, disrupt, or attempt to gain unauthorised access to the Services or any related systems.

Intellectual property

The Services, including all software, designs, text, graphics, names, and logos, are owned by Billes App Co Inc. and are protected by copyright, trademark, and other laws. Content you create within an application remains yours.

App store terms

Applications obtained through the Apple App Store or Google Play Store are also subject to the applicable store’s terms, including Apple’s Licensed Application End User Licence Agreement and Google Play’s Terms of Service. Where those store terms conflict with these terms in respect of your purchase, the store’s terms apply. Apple and Google are not responsible for the Services or for any claims relating to them.

Purchases and subscriptions

Any purchases, subscriptions, renewals, cancellations, and refunds are processed and administered by the app store through which you obtained the application, in accordance with that store’s policies.

Disclaimer of warranties

The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or that any data stored on your device will be preserved. You are responsible for maintaining your own backups.

Limitation of liability

To the maximum extent permitted by law, Billes App Co Inc. will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid for the relevant application in the twelve months preceding the claim, or CAD $50.

Termination

This licence remains in effect until terminated. It terminates automatically if you breach these terms. You may terminate it at any time by ceasing use of the Services and deleting the applications from your devices.

Governing law

These terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict of law principles. The courts located in British Columbia will have exclusive jurisdiction over any dispute arising from these terms.

Changes to these terms

We may revise these terms from time to time. The effective date above will be updated when we do, and continued use of the Services after a change constitutes acceptance of the revised terms.
